Collection

Collecting a debt involves legal and practical issues.  A creditor must comply with numerous applicable, federal and state, disclosure and procedural statutes and rules, while obtaining payment from the debtor. 

Effective debt collection often begins at the inception of the transaction.  Generally, longer forms that spell out the parties’ rights and obligations fare better than short ones; they eliminate confusion and close the door to a debtor's potential ambiguous-terms defense.  Additionally, since the American Rule requires that each party pay their own legal expenses absent agreement or statute, the best way to ensure that the creditor can obtain an award of legal fees in a judgment is to provide for them in loan and service agreements.
