Wills, Trusts and Estate Planning A will or testament is a document by which a person (i.e., the testator) governs the rights of others over his/her property or family after death. Inheritance and intestacy laws distribute property that is not disposed of by will. “Will” is a general term, while “testament” applies only to dispositions of personal property. A will can also create a “trust.” A trust created in a will is generally referred to as a “testamentary trust.” There is no legal requirement that a will be drawn up by a lawyer, however a homemade will can fall into many pitfalls. The person who makes a will is not available to explain him/herself, or to correct any technical deficiency or error in expression, thus, room for mistake is minimal. An improperly drafted or executed will can be challenged and result in the testator’s desires not being carried out. John J.
